Digital Evidence in Administrative Proceedings: Challenges and Specialized Skills for Lawyers in Vietnam

In the context of digital transformation and the development of e-government, the application of technical means to handle administrative violations is becoming an inevitable trend. However, practice shows that the increase in "digital administrative decisions" based on algorithms and electronic data poses a major challenge to the legitimate rights of individuals and organizations due to the volatile nature and technical errors of digital evidence. This article focuses on analyzing the specialized skills of lawyers in collecting, verifying, and refuting digital evidence to counteract errors from intelligent monitoring systems. By combining the theory of "Administrative Justice" and international precedents, the authors propose solutions to improve the evidence verification process and enhance the digital capacity of lawyers. This is a key factor in ensuring the supremacy of law and the proportionality of administrative sanctions in the digital age.
